Spenden und Beiträge an politische Parteien sind steuerlich absetzbar.
Dies hat einen überzeugenden Grund: Das politische Engagement, das sich durch die Mitgliedschaft und Mitgliedsbeiträge, aber auch durch Spenden an die Parteien äußert, soll unterstützt werden. Dies hat der Gesetzgeber so gewollt. Und dies hat auch das Bundesverfassungsgericht bestätigt. Das Gericht sieht in den Beiträgen und Spenden, die eine Partei erhält, auch ein Kriterium für die Zustimmung, die die Partei bei den Bürgerinnen und Bürgern genießt.
Das Einkommenssteuergesetz (EStG) kommt daher den Spenderinnen und Spendern mit zwei Regelungen entgegen:
- Die Lohnsteuer/Einkommensteuer (Steuerschuld) ermäßigt sich nach § 34 EStG um 50 Prozent der Beiträge und Spenden an politische Parteien, höchstens jedoch um 825 Euro, im Falle der Zusammenveranlagung von Ehegatten um 1.650 Euro (§ 34 EstG). Diese Steuerermäßigung gilt somit für Beiträge und Spenden bis zu insgesamt 1.650 Euro, bzw. 3.300 Euro bei Eheleuten.
- Darüber hinaus gehende Spenden und Beiträge bis zu weiteren 1.650 bzw.
3.300 Euro können nach § 10b Abs. 2 EStG als Sonderausgaben geltend gemacht werden. - Insgesamt kann ein/e Alleinstehende/r damit bis zu 3.300 Euro bei der Steuererklärung angeben, steuerlich gemeinsam veranlagte Ehepaare bis zu 6.600 Euro.
- Bei Spenden bis zu 200 Euro gilt der Kontoauszug oder der von der Bank bestätigte Einzahlungsbeleg des Auftraggebers als Spendennachweis für das Finanzamt.
